I understand that membership to Gym 3:23 is limited, and my membership application may not be accepted for any reason.

I agree to not bring children ages 7 and under onto Gym 3:23 property (gym, tennis court, parking lot, and grounds) unless I have one adult per 2 children constantly supervising the children.  Children ages 7 and under are not permitted onto the racquetball court and are not permitted to use any of the fitness equipment.  I agree to have at least one adult present if any youth under age 14 is on Gym 3:23 property.

I understand that if my membership is approved, gym hours are 6 am to 10 pm, 7 days a week.  Adults only may additionally use the gym from 4:30 am to 6 am, 7 days a week.  I agree to wear court shoes (no black soles and no outdoor use) only while in the gym.  Outdoor tennis court hours are 7 am to 9 pm, 7 days a week.

I understand that the gym feature(s) I want to use may be reserved by someone else so I may not always be able to use the gym.  I agree to look at the gym website and check my e-mail for reservations or closures prior to arriving at the gym.

I understand that I may reserve a portion of the gym for my use.  I agree to immediately cancel my reservation if I will not need the reservation.  I agree to reserve a single part of the gym for no more than 1 hour per day, 3 times per week.  I understand that my right to reserve any portion of the gym may be revoked if Gym 3:23 management feels I am overusing the reservations system.  This is completely at the discretion of Gym 3:23, and I understand that at any time I may lose my ability to reserve any portion of the gym for any reason.

I understand that I may not bring a guest onto Gym 3:23 property without prior approval from Gym 323 Staff.  All guest requests should be e-mailed to support@gym323fitness.com.  Please try to e-mail requests 48 hours in advance.  Guests may be granted one-time use of the gym at no charge with prior approval.

I understand that if I violate any of the terms of this agreement, I may lose my membership status and my right to use the gym.  I understand that no full or partial refunds will be given for any reason.  This includes having my membership revoked at any time for any reason.  This also includes my status living in this area, my health, or any other reason.  Membership fees are considered fully satisfied one day after my membership is accepted.

I understand that the gym is video monitored.  I understand I am responsible for my actions in the gym.  I agree to put away any equipment I have used before I leave the gym.  I agree to immediately report to Brian Hefty via e-mail (brian@heftyseed.com) any damage, improper use, or any other issues I become aware of while in the gym.

I agree to help clean the gym.  This includes mopping (using a very small amount of water only on a towel placed on the court broom) the basketball court or racquetball court prior to use.  This also includes picking up trash, placing basketballs & volleyballs on racks, hanging practice jerseys on hooks, picking up batting cage balls, and more.

This agreement is binding between Gym 3:23, LLC (hereby known as “the company”) and the individual(s) listed below.

In consideration of my use of the equipment and facilities provided by the company, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the company and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, my guest, or any member of my family in, on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the company. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me, my guest, or any member of my family and I hereby fully and forever release and discharge the company, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the use of said equipment and facilities.

I expressly agree to indemnify and hold the company harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me, my guest, or any member of my family.

I agree to be solely responsible for the safety and well-being of my guest, my family members, and myself. I understand that the company does not provide supervision, instruction, or assistance for the use of the facilities and equipment.

I agree to comply with all rules imposed by the company regarding the use of the facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.

I understand and acknowledge that for me, my guest, and any member of my family, presence on the property of the company and the use of any of the company’s equipment involves risk of serious injury, including permanent disability and death.

I understand and agree that the company is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.  This includes my vehicle parked on company property, and it includes weather events such as snow sliding off company buildings onto my vehicle.

If I, my guest, or any member of my family damages any equipment or property owned by the company, I agree to fully reimburse, replace, or compensate the company for the damage, including lost income, in a timely manner.

I understand and agree that my use of the facilities and equipment is only to be undertaken on my own personal time, and that my use of the facilities and equipment is not within the course or scope of my employment.

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.

Fees are due with membership application.  If your application is not approved, your money will be fully refunded.
